“Case तो चल रहा है… लेकिन जिस person का case है, उसकी Death हो गई।”
अब क्या होगा?
बहुत से लोग सोचते हैं कि Court case अपने-आप खत्म हो जाएगा।
लेकिन ऐसा हर case में नहीं होता।
Civil proceedings में Order XXII CPC death of parties और Legal Representatives यानी LRs को record पर लाने की procedure deal करता है।
अगर deceased party का right to sue survives, तो appropriate circumstances में उसके Legal Representatives को Court record पर लाया जा सकता है। Order XXII Rules 3 और 4 इसी तरह की situations के लिए provisions देते हैं।
और यहाँ सबसे important बात है — time limit को casually मत लीजिए।
Supreme Court ने 2025 में Order XXII के context में बताया कि prescribed period में substitution application न होने पर suit/appeal deceased party के संबंध में abate हो सकता है; इसके बाद abatement set aside कराने की अलग limitation भी सामने आती है।
इसका मतलब practical level पर क्या है?
अगर आपके Delhi matrimonial, property, inheritance या civil dispute में कोई plaintiff, defendant, appellant या respondent गुजर जाता है, तो तुरंत यह पता करना जरूरी हो सकता है:
Death की exact date क्या है?
Right to sue survive करता है या नहीं?
Legal Representatives कौन हैं?
Substitution application की जरूरत है या नहीं?
Limitation कब से चल रही है?
Case abatement की स्थिति में तो नहीं जा रहा?
Delhi High Court के recent decision में भी Order XXII Rules 1 और 3 को discuss करते हुए यह स्पष्ट किया गया कि death अपने-आप हर situation में abatement का मतलब नहीं है; जहाँ right to sue survives, proceedings को continue करने के लिए LR को record पर लाने की procedure महत्वपूर्ण है।

किसी litigant की Death को सिर्फ family matter समझकर Court file से अलग मत रखिए।
Court record में death की information, Legal Representatives और required application की procedure समय पर address करना जरूरी हो सकता है।
कभी-कभी family को लगता है —
“अभी तो अगली hearing पर देखेंगे।”
लेकिन limitation अपनी speed से चलती रहती है।
और अगर abatement की situation पैदा हो जाए, तो बाद में remedy लेने के लिए additional procedural steps और delay applications की जरूरत पड़ सकती है।

Delhi में legal awareness का मतलब सिर्फ case लड़ना नहीं है। Case में कोई major change होने पर Court record को भी समय पर update करना उतना ही important है।
अगर किसी pending case की party की Death हो गई है, तो date of death छिपाकर या ignore करके अगली hearing का इंतजार मत कीजिए।
आज की छोटी procedural information कल की बड़ी legal complication को रोक सकती है।
